Shipping Policies |
|
How does WineGlobe
know that I am of legal age?
You must be 21 years of age to order alcoholic beverages. Additionally,
all shipments of alcoholic beverages within the United States require
an adult's signature at the time of delivery. $2.75 additional cost of
acquiring a signature is included in the cost of S/H. Of course, orders
for non-alcoholic items (glassware, wine storage accessories, etc.) are
not restricted to certain states and can be shipped throughout the
United States.
How do I figure out if my State (U.S) is legal to accept
shipments from California?
Non-California residents are responsible for determining whether they
may lawfully import alcoholic beverages into their state. We make no
representation relative to your right to import wine or spirits into
your state. Each state has its own rules about alcoholic beverages. We
have listed a few rules below. You may want to check with the
appropriate agency in your state or county. If, between the date of
order and date of arrival, the laws of your state change so as to make
it illegal for you to import your shipment, you can return the order
for a full refund. You will, however, be charged for shipping and
handing of the product. Wineglobe will arrange for shipment on behalf
of the buyer, to an address specified by the buyer, provided that
Wineglobe in its sole judgment believes that such shipment will not
subject Wineglobe to the risk of any sort of legal action or other
harm. If a buyer lives in a state where the direct shipment of wine by
Wineglobe violates the law, we suggest that the buyer provide an
alternative address in another state or have their wine shipped to a
third-party storage facility in a direct shipping-friendly state. As a
service to our buyers, we have compiled a listing of these facilities,
which are not affiliated with Wineglobe. We do not provide an
endorsement of any facility and we recommend that you contact the
facility directly to determine if their costs and services meet your
needs.
Third party storage facilities within states we CAN ship to...
- Fifty-Five Degrees (St Helena, California:
707-963-5513)
- La Cave Wine Storage (several locations within
California: 650-692-4660)
- Northwest Distribution and Storage (Salem, Oregon:
503-362-2212)
- Portland Wine Storage (Portland, Oregon:
503-231-1121)
- WineBank (Menlo Park, CA: 650-327-9200)
Please contact them directly for their rules and regulations.
I will take Full Responsibility. Will WineGlobe ship me
wine?
Because of the widely variable and punitive laws controlling the
shipment of wine in the United States, we have created this section to
help you determine the restrictions and limitations that you may face
when buying wine online -- depending on who you are and where you are
shipping to. Any wine sold to you through Wineglobe is sold in
California and title passes to you, the buyer, in California. The buyer
is solely responsible for the shipment of wine. We make no
representations concerning your legal rights to ship or receive wine
into any state outside California or any country outside the United
States. In fact there are certain states and countries we cannot ship
to. By placing this order, you authorize us to act on your behalf to
engage a common carrier to deliver your order to your selected
designation.

please go to www.freethegrapes.com |
- Wyoming: For shipping to Wyoming, Wineglobe needs to
purchase a license for $50/year. This will allow Wineglobe to register
with Wyoming authorities and submit 12% tax collected for all sales.
- Nebraska: For shipping to Nebraska, Wineglobe needs
to purchase a license for $500 (one time). This will allow Wineglobe to
register with Nebraska authorities and submit tax collected for all
sales. Charge some additional amount for each shipping to cover the
$500 license fee.
- North Dakota: For shipping to North Dakota, Wineglobe
needs to purchase a license for $50/year. This will allow Wineglobe to
register with North Dakota authorities and submit tax collected for all
sales.
- Wisconsin: Currently no restrictions and taxes.
Beginning 2003, Wineglobe will be required to purchased a $10/annual
license and submit copy of all products shipped to Wisconsin.
- Virginia: Look into Virginia Law. In a decision
released July 27, United States Magistrate Judge Dennis Dohnal
recommended that Virginia law banning consumers from directly buying
wine from out-of-state wineries be held unconstitutional. Virginia now
requires all out-of-state wine sold in the state to be sold through
wholesalers and retailers. It allows Virginia wineries, by contrast, to
sell wine directly. Virginia wineries can thus bypass wholesalers and
retailers on some sales. Judge Dohnal found that Virginia's "professed
interest" in temperance was "fraught with contradictions" and that its
instate preference was "but a pretext for exclusion." In his view, none
of the state's asserted justifications worked to support its
discriminatory scheme. The judge had some question as to the right
remedy. The state could cure the discrimination, he said, by either
allowing out-of-state wineries to ship directly to Virginia consumers
or prohibiting Virginia wineries from shipping to them. Obviously
uncomfortable making such a choice, he suggested suspending any order
to give the Virginia Legislature time to decide which course to take.
All parties filed objections to the recommendation on August 29. Next
steps: Judge Williams will hear oral arguments on October 3 on the
magistrate's recommendation. Appeals will stem from that final
decision.
- New York: Follow up with news relating to NY alcohol
statute.
- Texas: Follow up with news relating to Texas alcohol
statute.
- Florida: Follow up with news relating to Florida
alcohol statute. Waiting for plaintiff's decision.
- Pennsylvania: Residents will be able to buy a product
from [a Web site] and then they will ship it to the state Liquor
Control Board, [which] will have it directed to a state store of your
choice. Customer will pay for taxes during pick up.
- Alabama:
a) the alcoholic beverages are to be ordered and paid for by the
individual.
b) The shipment is to be consigned, freight charges prepaid, directly
to the individual in care of an ABC store.
c) Upon payment of all taxes and assessments, the shipment will be
turned over to the individual at the ABC store.
- Georgia: Limited direct shipment allowed effective
July 1, 2000. Only those wineries which do not already have a
distributor in the state of Georgia may, for a $50.00 fee, apply for a
shipping license. Excise taxes must be paid to the state for all wine
shipped under the license. Please note that the annual limit for such
shipments under the license is a total of 50 cases into the state, with
no one consumer receiving more than 5 cases.
- Louisiana: Direct Shipment permitted to consumers
ordering from within Louisiana only if out-of-state winery does not
have wholesaler representation in that state. Direct shipment is
permitted to any Louisiana consumer who orders "sparkling or still wine
perfected on the premises of the manufacturer." Shipper Permit Required
& Ltd. Quantity, only without wholesaler representation. 4
cases per year
- Minnesota: Wineries with equal reciprocal shipping
privilege may ship, for personal use and not for resale, not more than
two cases of wine, containing a maximum of nine liters per case, in any
calendar year to any resident of Minnesota age 21 or over. Internet
orders are expressly prohibited.
- New Hampshire: No direct shipper shall ship more than
60 individual containers of not more than one liter each of liquor and
wine to any one licensee in New Hampshire or to any consumer or
consumer's address in New Hampshire in any calendar year (5 cases per
year). There are record keeping and reporting requirements to take
advantage of the "direct shipper" law.
- New York: New York residents who have personally
purchased alcoholic beverages while outside the U.S. for at least 48
consecutive hours and shipped to himself as consignee.

WineGlobe is happy to ship most
items in our store to most countries of the world. However,
international orders do require special handling, and shipping rates
vary greatly. Because of these issues, it is policy for WineGlobe to
fully research all international shipments before providing a final
shipping quote. If you place an international order, WineGlobe will
contact you with an accurate shipping price.
